Terms and Conditions

General Terms

  1. These terms and conditions apply to all transactions with In Common Breath Limited, registered in England.
  2. By making a purchase or pre-order, you agree to these terms and conditions.
  3. You must not use our website: (i) in a way that causes, or is likely to cause, the website or any of our service to be interrupted, damaged or impaired in any way, or (ii) for fraudulent purposes, or in connection with a criminal offence or other unlawful activity. We reserve the right to cancel any order, terminate any website account or refuse to provide any of our service if your behaviour gives us a justified reason to do so. This will in particular be the case if you are in breach of applicable laws, applicable contractual provisions, our guidelines or our policies, which are all accessible on our website, or if you engage in fraudulent activities or behaviour.
  4. These terms and conditions, together with the contents on our website, including current website prices, delivery details and contact details, set out the whole of our agreement relating to the supply of the goods to you. In particular, nothing said by any sales person on behalf of us should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. We shall have no liability for any such representation being untrue or misleading, save that nothing in these conditions limits or excludes our responsibility for fraudulent representations made by us.
  5. We reserve the right to change these terms and conditions at any time. Any updated terms and conditions will be posted on our website.

Your account

  1. Your account displays the history of purchase, saves your personal and contact information, if you wish to provide, and/or payment information.
  2. You are responsible for all sessions and transactions taken.
  3. Please keep your password safe and do not disclose to anyone including any member of our staff, we will never ask for your credentials at any stage.
  4. If you forget your password, you can reset your credentials on our website.
  5. If you have technical issues using your account, please contact In Common Breath Limited.

Purchases and payment

  1. All prices are in British Pounds (GBP).
  2. We are exempted from registering for VAT since all or most of our taxable supplies, or relevant acquisitions, are zero-rated. We do not have to account for VAT on the taxable supplies we make as we are not required by law to be VAT registered and we have not registered for VAT voluntarily.
  3. We reserve the right to change prices at any time without notice.
  4. We must receive the payment of the whole of the purchase before your order can be accepted and proceed.
  5. We accept the following payment methods: Visa, Mastercard, PayPal, Apple Pay, and Google Pay. All payments are processed securely through our website with Zettle payment gateway.
  6. By completing an order from our website, you must be the original cardholder for payment.
  7. Charging with your payment method does not mean that an order has been accepted by In Common Breath Limited. After payment has been processed, we will send an email to you at the email address you provide. The email will include your name, the order number and the total price charged. Dispatching your order shows our acceptance of your order and that brings into existence a legally binding contract between you and us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
  8. Online prices may differ from in-store prices.
  9. We reserve the right to cancel any order due to pricing errors or unavailability of stock.

Pre-orders and backorders

  1. Pre-orders are available for upcoming product releases.
  2. Backorders are available to selected out-of-stock items.
  3. Full deposit is collected when you make pre-orders or backorders on our website.
  4. We will notify you via email when your pre-ordered or backordered item is available.
  5. If you have purchased any pre-ordered or backordered items along with any in-stock items in the same order, All items in that order will be dispatched together once the pre-ordered or backordered items have arrived.
  6. In the event that we cannot provide the pre-ordered or backordered items in your order, we will issue a refund on those items.
  7. Prices for pre-orders or backorders may not be the same as when they are in stock.

Delivery

  1. We offer free delivery option(s) for purchases over £59 within the UK.
  2. For orders under £59, you are charged according to the size and weight of your purchase, and the shipping method you chose.
  3. Typically we dispatch any orders other than orders with pre-ordered or backordered items within 7 business days. The delivery time may vary based on the shipping carrier and external factors. You will be given the tracking number to keep track of your order if your selected delivery method is trackable.
  4. You are responsible to pick up your order at the location that you have indicated.
  5. For pre-ordered and backordered items, delivery times may vary and will be communicated at the time of order.
  6. International shipping may be available at additional cost, please contact us before making a purchase.
  7. We are not responsible for delays caused by customs processing for international orders. Risk of loss and title for items purchased pass to you upon delivery to the carrier.
  8. If the shipping is lost during transit, the shipping carrier is responsible for the loss of property.

Refunds and Exchanges

  1. We offer returns on items within 14 days of purchase, provided they are in their original condition, unopened with proof of purchase.
  2. Delivery fee is non-refundable.
  3. To initiate a return, please contact us for a return authorisation. Customers are responsible for the cost of return shipping unless the item is damaged or defective. This has to be communicated and agreed by both parties before initialising the return procedure.
  4. Refunds can be received in 2 forms:
    – Issuing a refund to the original form of payment within 14 days of receiving the returned item
    – Issuing a refund to a gift voucher that is non-transferable to other customers.
  5. Special orders, and personalised items are not eligible for return unless damaged or defective.
  6. If pre-ordered or backordered items are not dispatched within the designated period as advertised, you may be entitled to a refund. Please contact us to initiate your refund.
  7. Items purchased with a gift voucher will be refunded to a new gift voucher.
  8. We reserve the right to refuse returns that do not meet our criteria.

Customs Charges

  1. If you are ordering outside of the UK, you may be subjected to import taxes and/or duties. We have no control over additional charges in relation to customs clearance. You are solely responsible for any custom charges. You should contact your local customs for any enquiries regarding customs clearance and charges.

Privacy and Data Protection

  1. We collect and store customer information in accordance with the Data Protection Act 2018.
  2. We will not share your personal information with external parties except as required by law or for order fulfilment purposes.
  3. The details of how we process your personal information is listed in our privacy policy.

Intellectual Property

  1. The contents of any products listed on our website are subject to copyright of their respective holders. The copyright information, if any, is shown on the products.
  2. Text, graphics, photographs, or videos on a product page may be subject to copyright of the product’s copyright holder and these contents on our website are solely for product display purpose. All other content on our website is the property of In Common Breath Limited and protected by the Copyright, Designs and Patents Act 1988.
  3. All trademarks, product names and company names or logos used in our website are the property of their respective owners. No permission is given by In Common Breath Limited in respect of the use of any such trademarks, product names, titles or logos and such use may constitute an infringement of the holder’s rights.
  4. Any use of materials on our website (including but not limited to reproduction for purposes other than those noted above and modification, distribution, or republication) without the prior written permission of In Common Breath Limited is strictly prohibited.

Limitations of Liability

  1. Our liability for any claim arising from the purchase of goods shall not exceed the purchase price of those goods.
  2. We are not liable for any indirect or consequential loss arising from the use of our products or services.
  3. We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
  4. If any part of these conditions is unenforceable (including any provision in which we exclude its liability to you) the enforceability of any other part of these conditions will not be affected.
  5. The nature of Internet communications means that your communications may be susceptible to data corruption, interception and delays. We shall not be responsible for any detrimental reliance you place on this Website or its contents.
  6. We are providing our website and its contents on an ‘as is’ basis and makes no representations or warranties of any kind with respect to our website or its contents and disclaims all such representations and warranties, whether express or implied, to the fullest extent permitted by applicable law. In addition, We make no representations or warranties about the accuracy, completeness or suitability for any particular purpose of the information and related graphics published in our website or that any software or the server that makes it available are free of viruses or other harmful components. The information contained on our website may contain technical inaccuracies or typographical errors. All liability of us howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by applicable law.

  1. These terms and conditions are governed by and construed in accordance with the laws of England and Wales.
  2. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.

Interpretation

In these terms and conditions:

  1. ‘we’, ‘us’ and ‘our’ means (of) In Common Breath Limited, a private limited company registered in England (registration number 13507045) whose registered office is situated at 112 High Road, Beeston, Nottingham NG9 2LN;
  2. ‘working day’ means every day of a calendar year apart from Sundays, Saturdays and bank holidays;
  3. ‘business day’ means any day our bookstore on 112 High Road, Beeston, Nottingham NG9 2LN is open for business; and
  4. ‘you’ and ‘your’ means the person, or of that person, placing orders to us under these terms and conditions.
